So, after a series of rectification measures, how is the mining situation in the country? Why is the act of stealing mines repeatedly banned? What measures will be taken to rectify in the future? "Financial State Weekly" interviewed the Ministry of Land and Resources on the above issues.

"Finance and Economics Weekly": In August 2005, in order to solve the outstanding problems in the development of mineral resources, the State Council issued the "Notice on Comprehensively Rectifying and Regulating the Order of Mineral Resources Development" (Guo Fa [2005] No. 28, hereinafter referred to as "Notice"). In the past five years, what role has it played in curbing illegal illegal mining?

Ministry of Land and Resources: In general, various violations of laws and regulations in the development of mineral resources across the country have been thoroughly investigated and dealt with.

Since the "Notice" was issued, a total of 129,549 unlicensed exploration and mining cases, 9,490 super-layer and cross-border mining cases, 2,600 cases of illegal transfer of mining rights, and 48,377 mines that were illegally exploited and damaged the environment, were seriously polluted, and did not meet the conditions for safe production were closed. , rectify and shut down 11,155 small coal mines that do not have safe production conditions.

Since the first half of 2008, the Ministry of Land and Resources and other nine ministries and commissions have continued to carry out the "look back" campaign to consolidate and regulate the work, and investigated and dealt with 14,692 violations of various mineral resources, and closed 1,291 mines in accordance with the law.

According to statistics, since the "Notice" was issued, the average annual incidence of illegal mining has decreased year by year. During the "look back" period of the rectification and regulation work, the number of cases investigated and dealt with across the country has decreased significantly. The rebound of illegal acts of mineral resources has been effectively curbed, and the order of mineral resources development has become stable.

Caijing National Weekly: The crackdown on illegal mining has indeed achieved great results. But it is undeniable that in many areas, illegal mining still exists objectively. How can the Ministry of Land and Resources maintain such a crackdown for a long time?

Ministry of Land and Resources: In combating illegal illegal mining, the Ministry of Land and Resources and the National Development and Reform Commission have established an inter-ministerial joint meeting system with the Ministry of Public Security, the Ministry of Supervision, the Ministry of Finance, the Ministry of Environmental Protection, the Ministry of Commerce, the State Administration for Industry and Commerce, and the State Administration of Safety Supervision. , to form a cooperative working mechanism.

Other ministries and commissions are cooperating to follow up. Since the issuance of Document No. 28, a total of 905 violations of laws and regulations in the management of mineral resources development and management such as ultra vires approval, abuse of power, dereliction of duty and dereliction of duty have been investigated and dealt with nationwide, and 928 cases of investment and shareholding in coal mines by staff of state organs and heads of state-owned enterprises have been cleaned up and corrected. 148 people were punished by the party and government, and 45 people were transferred to judicial organs for handling. In order to more effectively strengthen law enforcement in mines and prevent collusion between officials and businessmen, all relevant departments have further standardized various links such as exploration and mining qualifications, project approval, enterprise establishment, production license, safety license, environmental protection approval, land reclamation, and geological disaster risk assessment. Administrative licensing has been improved, mining rights approval procedures have been improved, the threshold for applications for exploration rights and mining rights has been raised, and market access for mining rights has been strictly controlled. All localities actively promote the management system of separation of mining rights approval and management, and collective joint review.

Caijing National Weekly: During grassroots interviews, weak law enforcement has always been a headache for local land law enforcement departments. For example, in some counties, there are generally only two bureaus of mine management offices of land bureaus, while in townships, there are almost no full-time law enforcement officers. Team, in this case, how to strengthen mine management law enforcement?

Ministry of Land and Resources: This requires local governments at all levels to assume the main responsibility and vigorously promote the rectification and standardization work.

In fact, when implementing the spirit of Guofa [2005] No. 28 document, local governments at all levels creatively carried out a series of work in accordance with the actual situation and in accordance with the overall deployment of the State Council.

At present, the people's governments of all provinces (autonomous regions and municipalities) have effectively strengthened the rectification work of mines. Local people's governments at or above the county level have generally established leading groups with the main leader or the leader in charge as the team leader and the participation of relevant departments; rectification norms are listed as daily work Focus, clarify the annual goals and tasks; strengthen the annual and periodic supervision and inspection, and include the completion of the rectification and standardization work tasks in the assessment indicators of the grass-roots government.

Ministry of Land and Resources: It should be said that the development and integration of mineral resources has achieved phased results, and the unreasonable layout of mines has been significantly improved.

In accordance with the requirements of the state to strengthen the comprehensive development and integration of resources for important minerals, the provinces (autonomous regions and municipalities) have identified 56 integrated minerals, formulated an overall plan and an implementation plan, and included 5,830 integrated mining areas in the plan. Among them, 4,438 mining areas have completed the integration task. The original 58,814 mining rights in the integration area have decreased by 22,276 after the integration, and the number of mines in the country has decreased by 17.6% compared with that before the integration.

At present, most of the tasks of integrating mining areas have been completed in various places. Through the implementation of the development and integration of mineral resources, coal, phosphorus, bauxite and other mineral resources have been accelerated to the advantageous enterprises, and the scale, intensification and resource utilization level of the development and utilization of mineral resources have been significantly improved.
