The Ministry of Land and Resources held a teleconference today in Beijing on the special rectification of the development order of rare earth minerals and other minerals across the country. Zhang Hongtao, chief engineer of the Ministry of Land and Resources, revealed at the meeting that, in order to solve the outstanding problems existing in the exploration and exploitation of rare earth and other minerals, the Ministry of Land and Resources decided to carry out a special rectification action for the development order of rare earth and other minerals from June to November 2010, focusing on cracking down on illegal activities. Violations and indiscriminate mining and digging shall be focused on rectifying key areas, completely reversing the chaotic situation in some areas, and building a long-term mechanism for the supervision of development order.

Rare earth, tungsten, tin, antimony, molybdenum, high alumina clay, fluorite and other minerals (hereinafter referred to as rare earth and other minerals) are strategic mineral resources for the development of important emerging industries such as new material industry and high-tech industry in the world today, and are related to national security. , key materials for high-tech development and national economic construction. The central government attaches great importance to the protection and rational development and utilization of my country's rare earth and other mineral resources, and has repeatedly put forward requirements to further strengthen supervision and management. Since 2005, in accordance with the unified deployment of the State Council, all localities have rectified and standardized the development order of rare earth and other minerals in the work of rectifying and standardizing the development of mineral resources, and the management of rare earth and other minerals has achieved positive results. However, driven by interests, for a period of time, unlicensed exploration and mining of rare earth and other minerals, indiscriminate mining, and other behaviors are still prominent in some areas. It is difficult to effectively implement macro-control measures, and the problem of unreasonable mineral development structure has not been fundamentally resolved. To this end, the Ministry of Land and Resources decided to carry out special rectification actions for the development of rare earth minerals and other minerals from June to November 2010.

This special rectification is divided into three stages: from June to July, the stage of clearing, investigation and announcement; from August to October, the stage of punishment, supervision and rectification; and in November, the stage of inspection, summary and acceptance. According to reports, ten measures were taken to carry out this special rectification operation:

First, it is to comprehensively crack down on unlicensed exploration and mining activities. Resolutely ban illegal activities of unlicensed exploration and mining of rare earth and other minerals, promptly dismantle ground facilities for illegal projects, seal up equipment, fill wells, seal wellheads, stop the supply of water, electricity and pyrotechnic products, restore landforms, and confiscate mineral products and illegal gains .

The second is to conduct an in-depth inventory of the completion of the survey work. For behaviors that do not comply with the approved survey implementation plan, work progress, survey specifications, and fail to complete the minimum survey investment, order them to rectify within a time limit. If the rectification fails within the time limit, the original registration authority shall revoke or cancel the survey license.

Third, it is to severely crack down on the behavior of mining seeds that do not match the mining license. Mining rights holders whose actual mining types are inconsistent with those specified in the mining license shall be ordered to stop their illegal activities, confiscate mineral products and illegal gains, and treat them as unlicensed mining.

Fourth, it is to thoroughly clean up the behavior of mining beyond the approved mining area. Those who mine beyond their approved scope shall be ordered to return to their own mining area for mining, compensate for losses, confiscate mineral products and illegal and illegal incomes mined beyond the boundary, seal the tunnels that cross the boundary, and impose penalties according to law; refuse to return to the mining area for mining , the mining license shall be revoked in accordance with the law.

Fifth, it is to seriously investigate and deal with excessive mining. For production exceeding the control index or the production capacity specified in the mining license, it shall be ordered to rectify within a time limit. If the rectification fails within the time limit, the mining license shall be revoked or cancelled according to law. 

Sixth, it is to seriously investigate and punish acts of destroying mineral resources. For unlicensed mining, cross-border mining that causes damage to mineral resources, and destructive mining methods that cause damage to mineral resources, the person directly responsible shall be transferred to the judicial organ for criminal responsibility in accordance with the law.

Seventh, it is to comprehensively investigate and punish the illegal transfer of exploration rights and mining rights. Those who transfer exploration rights and mining rights without the approval of the examination and approval authority shall be ordered to make corrections, their illegal gains shall be confiscated, and a fine shall be imposed. Mining is punished.

Eighth, it is to supplement the preparation of the implementation plan for the integration of mineral development. For scattered exploration and mining areas with unreasonable distribution of high alumina clay, fluorite and other minerals that have not been included in the scope of key integration, a development and integration implementation plan should be supplemented, and after being approved by the provincial people's government, it should be reported to the Ministry of Land and Resources for the record and implemented in a timely manner.

Nine, is to establish a "coordinator" system. All mining areas set up mining area supervision responsibility plates one by one, indicating the name of the mining area, the name of the mining right holder, the main body responsible for supervision, the name of the coordinator and the telephone number for reporting. The provincial competent department of land and resources shall uniformly announce to the public the main body responsible for the supervision of all mining areas, the names of the coordinators and the reporting numbers.

10. Strictly investigate and deal with violations of laws and regulations such as unauthorised examination and approval of exploration rights and mining rights.

The Ministry of Land and Resources requires that the administrative departments of land and resources at all levels should further understand the extremely important strategic position of rare earth and other mineral resources from the perspective of implementing the scientific concept of development. Tasks; focus on the concentrated distribution areas of rare earth and other minerals, and conduct joint investigations; strengthen the exploration and mining planning of 7 kinds of minerals such as rare earth, reasonably allocate mining rights, and promote the rational distribution and orderly distribution of new mining rights; strict assessment and serious rewards and punishments.
